Moran dismisses class action for lack of movement

Class action attorneys who do not move cases forward should steer clear of Madison County Circuit Judge George Moran.

Moran dismissed Nash vs. Beelman River Terminals, a class action complaint not 10 months old, for want of prosecution.

Ronald Nash, of Edwardsville, sued last Dec. 9. He claimed that workers at Beelman, in Venice, did not receive time and a half after 40 hours a week.

He moved to represent a class of all who worked more than 40 hours in a week since November 2001.

Plaintiff attorney Elizabeth Heller of Goldenberg, Miller, Heller and Antognoli of Edwardsville signed the complaint.

Defense attorney Stephen Wigginton of Belleville answered Jan. 7.

Neither offered any motions. Moran set case management conferences throughout the year, but the parties continued them by agreement.

Heller and Wigginton showed up in Moran’s courtroom Sept. 28, among a throng that the judge had summoned. Moran had set 116 cases for that day.

Heller anticipated another rollover, but she did not get it. Over her objection, Moran dismissed.
