Eddie's Lounge attempts to dismiss wrongful death suit

Granite City tavern Eddie’s Lounge will be in court Oct. 26 attempting to dismiss a complaint alleging the tavern served too much alcohol to a patron who caused a fatal traffic accident.

Kathleen Gilbert claims that on July 11, 2004, Dawn Poston became intoxicated at Eddie's Lounge. While driving on Interstate 55/70, Poston struck the rear of Ronald Gilbert's van, which left the roadway and overturned. He died from injuries sustained in the accident.

According to court records, Poston has been charged with reckless homicide and driving under the influence of alcohol and is free on bond while she awaits trial. She has pled not guilty to all charges. Poston is not named as a defendant in Gilbert’s suit.

Gilbert, represented by Matthew Marlen of Belleville filed the suit June 13 in Madison County Circuit Court and is seeking at least $50,000 in damages, plus all costs of the suit.

Gilbert claims that as a result of Ronald’s death she and his two children have been deprived of the loss of society, including mutual benefits from the other’s continued existence, love, affection, care, attention, comfort and protection.

Eddie’s Lounge is represented by John Cunningham of Brown and James of Belleville.

Circuit Judge Daniel Stack will hear Eddie’s motion at 9 a.m.
