Metro rider claims injuries from abrupt stop

A man injured while riding on Metrolink filed suit in St. Clair County Circuit Court Oct. 6, seeking at least $50,000.

Wayne Smith claims be was riding the Metrolink from Missouri to Illinois on Oct. 22, 2004, when the train operator stopped abruptly causing him to be thrown forward.

According to to complaint, Metrolink failed to monitor traffic conditions, failed to keep a proper lookout for obstructions on the tracks, operated the train at a speed that was greater than reasonable, braked too quickly under the conditions, failed to warn passengers of an imminent stop and failed to use the highest degree of care of safety of its passengers.

Smith claims he suffered a disability and disfigurement, pain and suffering, medical bills, loss of income and an aggravation of a preexisting condition.

Smith is represented by Kevin Boyne of Belleville.
