A Bethalto woman is claiming at least $50,000 in damages for neck and back injuries sustained from falling into an uncovered hole at the Fairview Heights Metrolink station last year.
In a lawsuit filed Sept. 29 in St. Clair County Circuit Court, Jennifer Sales claims she was on her way to a St. Louis Cardinals game on Oct. 2, 2004, when the accident happened.
Sales, represented by represented by Eric Carlson of Edwardsville and Rod Pitts of Wood River, filed suit against Bi-State Development Agency.
According to Sales complaint, Bi-State was negligent by removing a tree from a sidewalk tree grate and failing to cover the hole, failing to barricade the hole in the sidewalk, failing to warn her of the hole, and failing to provide adequate lighting.
She claims Bi-State failed to make a reasonable inspection of the sidewalk and allowed and permitted a hole to remain and exist on the sidewalk knowing the hole created a dangerous condition.
Sales claims she experiences pain and suffering, lost wages, became liable for medical expenses and has lost the enjoyment of her life.
