Eddie's Lounge
Kathleen Gilbert, administrator Ronald Gilbert's estate, filed suit in Madison County Circuit Court June 13 against Eddie’s Lounge in Granite City alleging the tavern served too much alcohol to a patron who caused a fatal traffic accident.
Gilbert claims that on July 11, 2004, Dawn Poston became intoxicated at Eddie's Lounge. While driving on Interstate 55/70, Poston struck the rear of Ronald Gilbert's van, which left the roadway and overturned. He died from injuries sustained in the accident.
“Shortly after the collision, blood and urine levels samples were obtained from Poston at Anderson Hospital, which revealed she had a blood alcohol content of .151 and a urine ethanol content of .194,” the complaint states.
According to court records, Poston has been charged with reckless homicide and DUI and is free on $5,000 bond while she awaits a June 11 trial. She has pled not guilty to all charges.
Gilbert claims that as a result of Ronald’s death she and his two children have been deprived of the loss of society, including mutual benefits from the other’s continued existence, love, affection, care, attention, comfort and protection.
Gilbert, represented by Matthew Marlen of Belleville, is seeking at least $50,000 in damages, plus all costs of the suit.
The case has been assigned to Circuit Judge Daniel Stack.
