Alton woman sues property owner for assault

While checking out a rental property for her family's move, Stacey Stegall claims she was sexually assaulted by the owner, Gene Kain of Alton, who was showing the home at 2819 Sanford Ave. in Alton on Aug. 3, 2004.

Seeking in excess of $50,000 in damages, Stegall, of Alton, filed suit against Kain in Madison County Circuit Court June 6, claiming she was injured, bruised, embarrassed, humiliated and frightened by the incident that took place in the basement of the rental property.

According to the complaint, Kain made comments about Stegall's breasts.

"The plaintiff told him to stop talking about such matters and then went upstairs for the purpose of leaving," the complaint states.

"The defendant then followed the plaintiff upstairs and pulled on the plaintiff toward a bedroom and grabbed and groped the plaintiff..."

"The plainiff had to physically struggle to be from from defendant's grip."

Stegall, represented by G. Ronald Kesinger of Jacksonville, claims she did not consent to any touching of her body.
