Rusty�s on North Main in Edwardsville
An Edwardsville restaurant was named in a breach of contract lawsuit filed by Middendorf Holdings on May 23 in Madison County Circuit Court.
According to the complaint, Rusty’s on North Main has failed to make payments to Middendorf pursuant to a credit agreement, and is indebted $84,450.54.
Middendorf claims that under the terms of the contract, Rusty’s agreed to pay interest at the rate of 18 percent per annum on each delinquent payment.
“Demand for payment has been made upon Rusty’s, and payment was refused,” the complaint states.
Middendorf, represented by Donald Horowitz of the Vogler Law Firm in St. Louis, is seeking at least $84,450.54 with interest, court costs, and any other relief the court deems just and proper.
The case has been assigned to Circuit Judge Daniel Stack.
