A driver whose airbag failed to deploy in a one-car rollover accident is suing DaimlerChrysler and Auffenberg Ford for more than $150,000 in St. Clair County Circuit Court.
In the suit filed May 13, Sandra Missey claims her face, arm and body as a whole were injured Sept. 19, 2004, after she swerved to avoid hitting a deer while eastbound on Midgley Neiss Road in St. Clair Count.
According to the suit, her pickup truck hit an adjacent ditch and rolled over.
Missey, who is represented by Stephen Kernan of Cook, Ysursa, Bartholomew, Brauer & Shevlin of Belleville, claims DaimlerChrysler is negligent for a defective air bag design.
She bought the used vehicle from Auffenberg Ford North in January 1999. Missey claims Auffenberg was negligent because it should have known that the air bag system would fail to deploy in a front end collision.
