Cathryn Jaeger of Bellevile filed a suit against Missouri-based Walpert Properties and Mainline Plaza for tripping on dangerously uneven asphalt in their parking lot. She is seeking damages for injuries in excess of $100,000.
In a suit filed May 13 in St. Clair County Circuit Court, Jaeger claims she tripped after exiting a grocery store at 4513-19 West Main St. in Belleville. The incident took place on June 16, 2003.
"Walpert Properties should have known the dangerous condition existed, and that Jaeger did not know, and in the exercise of ordinary care could not have discovered that such condition was not reasonably safe," the complaint states.
Jaeger claims Walpert allowed uneven pavement on its parking lot and failed to warn pedestrians of the dangers the asphalt posed.
According to the complaint, Jaeger suffered severe and disabiling injuries to her knee and other body parts, suffered physical and mental anguish, and has become liable for medical expenses.
Jaeger also claims she has been unable to perform her work and activites as she has in the past, "all to the harm and injury in a substantial sum of money."
She is represented by Stephen Buser of Columbia.
