Mitchell tavern sued for selling too much liquor

A man who was kicked, punched and tossed to the ground filed suit against the Luna Café in Mitchell claiming the tavern sold too much liquor to his unknown assailants.

Represented by James Gorman of Lucco & Brown of Edwardsville, Kevin Sitton is seeking at least $100,000 in damages for his alleged injuries in a suit filed May 16 in Madison County Circuit Court.

Sitton claims the incident took place on Nov. 23, 2004, and blames the tavern for failing to protect him against the misconduct of a third party. The complaint also states Luna Cafe failed to train its bouncers, failed to supervise bouncers, and failed to remove patrons from the premises after it had become apparent those persons posed a threat.

According to the complaint, Sitton sustained severe and permanent injuries, has become hindered from attending to his usual duties and affairs, suffers great pain and mental anguish, and has become liable for large medical expenses trying become cured of his injuries.

The case has been assigned to Circuit Judge Andy Matoesian.
