Ashley Peach of Granite City, who filed class action suits against three stores for refusing to give change on gift card purchases, has dropped one of the suits.
Peach moved April 28 to dismiss her complaint against Charming Shoppes Inc., doing business as Fashion Bug.
Peach's complaint, filed last June by Jeffrey Millar of the Lakin Law Firm, claimed that she asked for $8.96 change on a $30 gift card that her mother, Armettia Peach, gave her. Mother and daughter stated in depositions that a gift card was the same as cash.
"Plaintiff's voluntary dismissal is not part of any compromise or settlement of any claims of any member of the proposed class," wrote Millar in the motion to dismiss.
Ashley Peach's class action suits against K-Mart and Wal-Mart continue. K-Mart has moved to dismiss. Judge Byron will hear the motion May 20. (See related story).
