Trackman files FELA suit against Norfolk

Crow Nelson filed a Federal Employers' Liability Act suit May 6 in Madison County Circuit Court against Norfolk Southern Railway alleging that he was injured while working as a trackman and machine operator.

Represented by Greg Tobin of Pratt & Tobin of East Alton, Nelson is seeking a judgment in excess of $50,000 and for all costs of the suit.

According to the complaint, throughout Crow’s 30-year railroad career he was subjected to repetitive trauma while using a "brush-hog" repairing railroad tracks for Norfolk.

Nelson claims Norfolk failed to provide him with a safe place to work, safe work methods, and sufficient manpower and safe tools and equipment to perform his duties.

As a result, Nelson claims he sustained injuries to his neck, back, spine and body causing in disability and disfigurement, mental anguish, loss of earnings and medical bills.

The case has been assigned to Circuit Judge Andy Matoesian.
