Elderly man sues Motomart for nearly causing "untimely death"

Motomart 721 West Main, Belleville

An 81-year-old farmer who slipped and fell at a Belleville Motomart filed suit March 21 in St. Clair County Circuit Court seeking damages for almost dying.

Albert Hummert claims that on Oct. 14, 2004, he slipped on accumulated rain water at the Motomart located at 721 West Main St. As a result, Hummert suffered a severely debilitating and disabling fractured hip.

“Hummert has suffered painful and permanent hip leg injuries, which have also led to other physical complications, which nearly caused his untimely death,” the complaint states.

According to the complaint, Motomart breached its duty of care by not having adequate rugs placed near the entrance and failing to mop the floor.

Prior to his fall, Hummert claims he enjoyed a relatively healthy and vigorous life, but due to his broken hip he now suffers the loss of enjoyment of life he would have otherwise had.

Hummert also claims Motomart ignored him and refused to help him after he fell, requiring good Samaritan, non-employees to come to his aid.

“Evidence of Motomart’s callousness to Hummert, and ignorance of his condition, Motomart’s employee had Hummert pay for his gasoline instead of helping him,” the complaint states.

Represented by Eric Rhein of Belleville, Hummert is seeking at least $100,000 for injuries, medical bills, great pain and mental anguish, permanent disability, and being required to live in a nursing home.
