Circuit Judge George Moran granted the defendant's motion to dismiss for want of prosecution over the plaintiff's objection. Moran also dismissed all remaining counterclaims and third party complaints.

Both parties asked Judge Phillip Kardis to continue the February trial docket date to a later date. Kardis granted the motion and set an Oct. 17 trial in Granite City at 9 a.m.

This case was settled out of court. Moran dismissed the case with prejudice.

A hearing to dismiss the case based on forum non conveniens was called and heard by Judge Kardis. Plaintiff did not appear in court and case was transferred to Marion or Massac County, the plaintiff can choose.
