An Alton car wash which invested $123,000 in machinery is suing an equipment supplier for $70,000 because the parts didn't work properly after installation.
Wash Barn filed suit against Advanced Cleaning Technologies of Missouri on Jan. 14 in Madison County Circuit Court.
Represented by Robert Larson of Alton, Wash Barn claims that on Aug. 28, 2002, it entered in a contract with Advanced for equipment and supervision, expertise, and assistance on installing and operating the car wash equipment.
“The plumbing and heating equipment sold by the defendant to the plaintiff and installed under defendant’s supervision was improperly arranged, placed and located and was not installed in a workmanlike manner,” the complaint states.
Wash Barn claims Advanced has refused to repair the equipment. Due to the equipment failure, Wash Barn was forced to close during cold weather in 2003 and 2004 and lost profits and earnings it would have earned if the plumbing was properly installed by Advanced, the suit contends.
The suit also claims that substantial expense has been incurred by Wash Barn in an effort to repair the alleged faulty equipment and will in the future be required to spend money to fix the equipment.
The case has been assigned to Circuit Judge Daniel Stack.
