Mandy Byrd v. City of Wood River and East Alton Wood River School District

  • The school district was dismissed with prejudice and Judge Philip Kardis set a trial date for the city of Wood River on Dec. 5, 2005.

    Ronald & Phyllis Yenrich v. Cassens and Sons et.al
  • The defendants filed a motion to strike plaintiffs' submission on the alternative opposing motion to amend complaint for punitive damages.

    Carmelita McLaughlin individually and on behalf v. Alliance Mortgage
  • Cause was called for a hearing on the defendant’s motion to dismiss for failure to join a necessary party and to disqualify plaintiff's counsel for violations of rules and professional conduct. The court finds that the motion to dismiss is denied. Defendants will add Centerre Title and Wyss as third party. Defendant’s motion to disqualify attorneys of record was also denied.

    Timothy Werner v. Werner Mick Funeral Home
  • A motion for default judgment was called and heard. Defendant or its counsel failed to appear, and plaintiff’s motion is granted. Judge Kardis finds that Werner Funeral Home to be in default, and entered judgment against it. A hearing on damages is to be held on Feb. 3, 2005.

    Paul Graves v. Rosewood Care Center
  • A civil jury trial was set by Judge Kardis for June 13, 2005, at 9 a.m.

    Elizabeth Prohaska v. Abbott Labs et.al.
  • This case was continued as a new judge needs to be assigned to the case. Judge Kardis was the original judge.

    Peggy Gaudreault et.al. v Union Planters Bank & James R. Gibson
  • Gibson filed a motion to defend as a poor person. All pending motions were reset by Judge Kardis until Jan. 27, 2005.

    Mark Wilson v. Lincoln Electric et.al.
  • Judge Byron ordered that the court reserves ruling on defendants on request to dismiss plaintiff's first claim conspiracy and fraudulent concealment and to allow plaintiff to continue discovery on his conspiracy allegations. This is a weld rod case.

    Frank Bono v. Lincoln Electric et.al.
  • On Dec. 20, Judge Byron dismissed this weld rod case without prejudice and ordered all defendants dismissed with each party to bear own costs.
