  • A civil jury trial has been set May 16, 2005, with Circuit Judge Phillip Kardis presiding.

  • The court having fully considered the parties' stipulation to dismiss; orders that cause number 02 L 856 is dismissed with prejudice with each party to bear its own attorney fees and costs.

  • A case management conference was held by telephone with both parties.

  • A class certification hearing has been set for June 27, 2005, at 9:30 a.m. in Granite City. Circuit Judge Phillip Kardis will preside.

  • Judge Kardis ruled that 220 ILCS 5/13-502.5(a-f) violates the provisions of the Illinois Constitution article IV and articles I and II. He further ruled that this declaration of unconstitutionality has no effect on the remainder of the act. As to pleadings, plaintiff's motion for partial summary judgment is granted, and defendant's motion to dismiss is denied. A notice of appeal and filing was filed by both defendants and a copy of the appeal was mailed to the appellate court. The appeal was sent to the appellate court in error, and Madison County phoned the appellate court to inform them that the appeal should have been sent straight to the Supreme Court. The appellate court gave the case docket number 5-04-0647 and a due date of Dec. 7.

  • A Nov. 7 hearing has been set for a forum non conveniens dismissal motion filed by Petco. It will be heard at 9:30 a.m.

  • Intel was granted leave to substitute exhibit B of its response to plaintiff’s motion for reconsideration of the July 12 order for class action certification.

    Molly Alter v. Starbucks
  • Judge George Moran set a motion hearing for Nov. 24 at 9:30 a.m. for Starbucks' motion to dismiss. A case management conference will also be held that day.
