Alton woman wants $50K+ over chicken breast

While biting into a chicken breast at a Springfield Cracker Barrel restaurant, Velma Burks of Alton, injured herself.

Three years after the incident occurred, Burks and her husband, Larry, filed a lawsuit Friday in Madison County's Law Division, alleging that she hurt her mouth and teeth. The chicken breast was unfit for human consumption, the complaint states.

Burks and her attorney, Doug Mendenhall of the Alton law firm Smith, Mendenhall and Selby, could not immediately be reached for comment. The suit seeks to recover damages no less than $50,000.

CBRL is the holding company for Cracker Barrel and Logan’s Roadhouse. This is the first time CBRL has faced litigation in Madison County.

Cracker Barrel has been sued 18 times in Madison County in recent years. The Springfield Cracker Barrel in question is located at 5975 South 6th St.

Tyson Foods, also named in the suit, is the largest protein provider including chicken, beef, and pork in the country. This is the second lawsuit pending in Madison County against Tyson. The other pending case is a class action case that was filed in 2001.
