Class Action: Darrell Nash v. Sears Roebuck

On Friday October 8, Judge Moran will hear Sears' motion to dismiss the class action lawsuit Darrell Nash v. Sears Roebuck and Company.

Nash, a resident of Jersey County, alleges that the range he bought at Sears in October 2001 was not property installed. Specifically, Sears did not install 'anti-tip brackets,' Nash alleges, putting him in danger and Sears in breach of its warranty.

In his lawsuit, Nash is not claiming that his range tipped over or that he was injured. He wants $60-125 to have the brackets installed.

St. Louis-based Korein Tillery represents Nash. The Edwardsville firm Burroughs, Hepler, and Broom represents Sears in the suit.

According to the complaint, Sears sells 800,000 ranges per year.

Hoffman Estates-based Sears has stores in Edwardsville, Collinsville, Alton, and Fairview Heights
