Filed by Dennis Strasen in late 1999, this suit accuses the Allstate Insurance Company of violating the Illinois Consumer Fraud Act(ICFA) by reviewing its policy holders' medical bills using claims-auditing software, and then refusing to pay some of the bills on unreasonable grounds.
Strasen contends that all medical bills and treatment are reasonable because they were performed by a licensed medical provider.
On Friday Allstate, represented by Edwardsville firm Burroughs, Helper, Broom, MacDonald, Hebrank, & True argued its motion to dismiss for failure to state a claim.
Allstate also claims that Illinois courts have expressly allowed insurers to review medical bills using the very type of computer database toward which Strasen directs his complaint.
