Missouri man, mental health clinic allege wrong insurance claim

A mental health center and one of its patients sued an insurance carrier, alleging it did not properly handle a claim and court appeal.

Raheem Adegboye, of Missouri, by and through an assignment by Comprehensive Mental Health of St. Clair County, filed a complaint on March 12 in St. Clair County Circuit Court against Scottsdale Insurance Co.

Comprehensive Mental Health retained Scottsdale Insurance to insure liability claims made by Adegboye against it in St. Clair County Circuit Court. (case no. 05-L-210).

According to the complaint, Scottsdale Insurance owed the plaintiffs a "degree of care as a reasonably careful and prudent insurer would exercise under the same or similar circumstances" but the defendant didn't meet this legal duty.

The plaintiffs cite vexatious refusal and breach of contract.

The plaintiffs seek damages in excess of $50,000, plus costs. They are represented by attorney John J. Pawloski in St. Louis.
