A St. Clair County woman claims she sustained injuries resulting in a leg amputation when the nursing center van she was being transported in was involved in a collision.
Roshonda Lee, filed a lawsuit April 6 in St. Clair County Circuit Court against Bria Health Services, Atrium Healthcare and Rehabilitation Center of Cahokia, Jerome Lane and Daniel Doe, an unnamed veterinarian.
According to the complaint, Lee, who suffers from diabetes, kidney failure and a right leg amputation, was a resident of the Cahokia facility. She claims she was being transported by Doe on Nov. 18, 2014, by wheelchair in the van from the facility to a dialysis treatment center.
While en route to the center, Doe lost control of the van and wrecked the vehicle, the suit states. As a result, Lee was ejected from her wheelchair during the crash and landed on the floor, fracturing her left leg. The suit says Doe and the defendant facilities are responsible, for the driver, who operated the van at an unreasonable speed, failed to operate the van on the roadway, failed to seat-belt or secure Lee to her wheelchair, failed to provide Lee with suitable assistance and failed to create or enforce suitable transportation protocols.
Following the accident, the fracture was allegedly misdiagnosed and mistreated, causing the leg to be amputated on Dec. 23, 2014.
The plaintiff alleges injury and amputation, pain, suffering and medical expenses.
Lee seeks damages in excess of $200,000. She is is represented by attorney Lanny Darr of Schrempf, Kelly, Napp and Darr in Alton.
