Madison County Circuit Judge Andreas Matoesian awarded a travel company default judgment in the amount of $354,798 in a case alleging a travel company failed to secure accommodations for a business retreat.
Matoesian’s March 19 order granted default judgment for YTB Global Travel Inc. and against defendants Travel Opportunities LLC and Grant Merz.
According to YTB’s June 18 lawsuit, the plaintiff claims it executed an agreement with Travel Opportunities and Grant Merz on March 6, 2014, for accommodations at a resort in Cancun, Mexico, for the plaintiff company’s regional meeting from Aug. 7-14.
In accordance with the agreement, the plaintiff paid $152,080 in deposits prior to May 28, when Merz contacted the plaintiff about not being able to execute the agreement as promised.
As a result, YTB’s president requested a refund of the deposits, but the defendants have failed to repay the deposits, the suit claims.
The defendants are accused of breach of contract, conversion, consumer fraud and a violation of the Deceptive Business Practices Act.
YTB filed its motion for default judgment on Jan. 2, arguing that neither defendant made any attempt to enter their appearance after being served the summons and complaint in November.
