Man sues driver, alleges auto accident injuries

An O'Fallon rear-end auto collision results in a St. Clair County lawsuit.

Bobby Deadmond Sr. brought a complaint March 20 in St. Clair County Circuit Court against Douglas Marshall, claiming recklessness in a December 2014 motor vehicle accident.

According to the complaint, Deadmond was driving north on Lincoln Avenue in the O’Fallon on Dec. 5, 2014, when the defendant, driving directly behind him, allegedly struck his vehicle.

Deadmond accuses the defendant of failure to keep a proper lookout for other vehicles, apply brakes, operate the vehicle at an appropriate speed and failure to keep a safe distance between the cars.

Deadmond claims the collision left him sick, sore and disabled. He also claims he incurred injuries to his neck, shoulder and back, as well as soft tissue and muscles. He contends that he has had to expend money for medical care, treatment and services and expects that to continue in the future.

Alleging pain and suffering, lost wages and impaired earning capacity, the plaintiff seeks damages in excess of $50,000, plus attorneys’ fees and costs.
