Woman files suit for injuries in traffic incident

A St. Clair County woman filed a lawsuit against a driver for allegedly causing an auto accident that resulted in injuries.

Darla K. Lancey filed the lawsuit on March 19 in St. Clair County Circuit Court against Thomas T. Orcutt, alleging vehicular negligence in an April 2013 motor vehicle accident in Mascoutah.

According to the complaint, Lancey was traveling westbound on West Main St. at the intersection of North County Rd. in Mascoutah on April 20, 2013. Orcutt, traveling eastbound on the same road, turned left onto North County Rd.

The suit states that the defendant failed to stop, swerve or control his vehicle in order to avoid collision with another vehicle at that point, drove at a speed greater than was reasonable and proper in relation to the traffic conditions. The defendant is also accused of failing to keep an adequate lookout ahead and to the side, equip his car with adequate brakes and yield the right of way.

Lancey claims she suffered injuries that caused her pain and anguish and limited her attendance to everyday duties.

Lancey seeks damages in excess of $50,000, plus attorneys’ fees and costs. She is represented in the case by Kenneth Beljanski and Trent West of Brown & Brown in Fairview Heights.
