A Washington County mother and grandfather filed suit against a St. Clair County woman for allegedly causing injuries in a March 2013 collision.
Jerry Borrenpohl, of Addieville, and Jill Borgmann, mother and next friend of minor Devin Borrenpohl, of Nashville, Ill., filed the lawsuit on March 17 in St. Clair County Circuit Court against Linda Popp, of Mascoutah, alleging negligence.
According to the suit, Devin Borrenpohl was a passenger in his grandfather’s 2009 Ford Escape traveling westbound on Thouvenot Lane in Shiloh when the defendant crashed her 2013 Nissan Juke into the vehicle on March 19, 2013.
The suit states that Popp negligently failed to keep a proper lookout, drive at a reasonable speed, decrease her speed to avoid collision, decrease her speed near an intersection and sound her horn to warn the occupants of the plaintiff’s vehicle.
According to the complaint, both Jerry Borrenpohl and Devin Borrenpohl were severely and permanently injured, disabled and disfigured. They suffered physical pain, mental anguish and medical expenses, plus diminished employment capacity and lost wages in Jerry Borrenpohl’s case, the suit states.
The plaintiffs are seeking damages in excess of $50,000, plus attorneys’ fees and costs.
The family is represented by Kenneth Halvachs, Ronald J. Abernathy Jr. and Kevin Dawson of Halvachs & Abernathy in Belleville.
