Property owner sues auto dealer for unpaid rent

A Madison County real estate firm filed a complaint against an auto dealership and credit company for unpaid rent.

CDMJ Real Estate LLC brought the suit in Madison County Circuit Court on March 27 against St. Louis Cars and Credit, Inc. of St. Louis, doing business in Madison County, and John and Jamie Aronson as individuals and personal guarantors, alleging breach of lease and personal guaranty in a lease agreement originating in Jan. 2011.

The plaintiff owns property located at 17 Liberty Place in Pontoon Beach. According to court documents, the plaintiff and defendants entered into a contract on or about Jan. 14, 2011, wherein SLCC rented the property from CDMJ. Terms included payment of rent, taxes and all utilities and services, according to papers filed.

The defendants renewed their lease on or about March 1, 2014. The plaintiff alleges SLCC breached the lease in June 2014 by failing to make a full payment. As a result, CDMJ claims monetary damage in the amount of $129,116.00.

Additionally, the suit states that the defendants gained insurance proceeds in the amount of $15,000 for damage to a sign on the premises but failed to repair the sign or turn the gains over to the plaintiff as required by law, according to the complaint.

CDMJ seeks to recover damages in a total amount of $144,116.00, plus attorneys’ fees and costs. The firm is represented in the case by attorney David Page of Resolute Law Office, St. Louis.
