A lawsuit alleging a Wood River police officer texted a woman inappropriate messages has been dismissed with prejudice.

The parties filed a joint stipulation for dismissal on Jan. 23, and Circuit Judge Andreas Matoesian granted the parties' request.

Traci Quigley filed suit against the City of Wood River and Jeremy Elliott last June.

According to the complaint, Elliott allegedly ran Quigley’s name through his police computer to determine whether she had any existing warrants and retrieved her personal information, including cell phone number. She claims he then used the information to text her inappropriate sexual suggestions over the course of several weeks and that he would drive by her home and park nearby.

The defendants were accused of intentional infliction of emotional distress and negligence.

Calling the allegations “sparse,” the City of Wood River argued that Quigley failed to provide sufficient facts in her claims and failed to meet her burden when pleading “extreme and outrageous” conduct or “severe emotional distress.”

“Mere embarrassment and distress is insufficient,” the motion states.
