A Madison County man is suing the driver of a vehicle in which his daughter died as a passenger in a crash on March 1, 2014 in Jefferson County, Mo.
A lawsuit filed on Feb. 9 in Madison County Circuit Court alleges that Jarrett D. Greene's daughter, Bryleigh Nicole Green, was a passenger in a 2004 Chevrolet Cavalier operated by Theresa A. Godwin. According to the lawsuit, Godwin made a turn "without warning" across the path of a Dodge Ram truck operated by Steven B. Galvin, causing the death of Bryleigh Nicole Green.
"It was the duty of .. Godwin .. to exercise reasonable care under the circumstances to protect the safety of .. Greene..," the lawsuit states.
The lawsuit filed by attorney Steven Dioneda, of Kullmann, Klein and Dioneda, states that due to carelessness and negligence, and a failure to decrease speed in a proper way and yield properly to the other driver's right of way, Jarrett Greene, the executor of his daughter's estate, is entitled to damages in excess of $50,000, plus court costs.
