The publication ranked three of the firm's defense wins in 5th, 13th and 15th places, in verdicts where plaintiffs had sought $16.3 million in total damages.
In Bradshaw v. Mercy Clinic, attorneys Ken Bean and Bobbie Moon, received a defense verdict for an OB–GYN defendant after a three week trial in Phelps County, Mo. Plaintiffs alleged failure to obtain informed consent, failure to properly interpret fetal monitoring strips and failure to perform a timely caesarian section. With plaintiffs seeking pecuniary damages of $13.46 million, the jury returned a verdict for the defense.
Attorneys Rodney Sharp and Dennis Harms successfully defended Meyers v McCarthy, another complex medical malpractice claim, in St. Louis County. In this case, the plaintiff alleged a failure to diagnose and treat a benign spinal lesion, causing bladder and bowel incontinence and erectile dysfunction. Plaintiff’s counsel demanded the available insurance policy limits before trial. After rejecting the demand, Sandberg Phoenix attorneys obtained a defense verdict from the jury.
Tullock v. Success Health Corp., et al involved a medical negligence/wrongful death claim against a client defended by John Sandberg and Sara Obermark. The plaintiffs alleged the defendants failed to timely diagnose and treat an ascending aortic aneurysm after the decedent presented to the ER with complaints of abdominal pain. Sandberg Phoenix attorneys received a unanimous defense verdict. The lowest demand from plaintiff’s counsel was $2.2 million.
