Maryville landlord sued over tenant's driveway fall

A tenant of a Maryville property is suing her landlord over injuries sustained in falling in a driveway pothole.

Melissa Miller filed suit against Victoria Kalicki on Feb. 17 in Madison County Circuit Court.

Miller claims the driveway of the rental property at 6118 West Main St. progressively deteriorated after she had moved in, and despite informing Kalicki of the "dangerous condition," the defendant "never responded with remedial action," the suit says.

According to the complaint, snow had covered the uneven surfaces of the driveway. Miller claims that she stepped in an uneven portion of gravel and/or a deep pot hole and fell on March 25, 2013.

She claims she sustained severe bodily injuries to her left wrist which required surgery with permanent hardware.

Among other things, Miller blames Kalicki for failing to properly repair the driveway even after notifying her of its condition.

Miller seeks in excess of $50,000 in damages. She is represented by Michael Gliss on Alton.
