Parents sue doctor, facility for injuries alleged in childbirth

A couple has filed a lawsuit against an obstetrician, his affiliated medical practice and associated hospital facility for alleged breach of duty in childbirth-related injuries incurred in February 2013.

Jody L. McGhee and Jade McGhee, of St. Clair County, sued Melvin D. Merritt; O.B. Obstretrics, LLC, also known as Women’s Care of Southern Illinois; Memorial Medical Group, LLC, also known as Memorial Medical Group; Protestant Memorial Medical Center, Inc., doing business as Memorial Hospital, of location/state, Feb. 2 in St. Clair County Circuit Court claiming several counts of negligence.

According to the complaint, when Jody gave birth to a baby boy on Feb. 3, 2013 she suffered perineal tearing severe enough to cause permanent disability. Specifically, the suit states that Jody now suffers incontinence and lower gastrointestinal bleeding.

The plaintiffs allege that the defendant was remiss in his duties by failing to: recognize and treat fourth degree perineal lacerations in the mother following delivery; perform an episiotomy to avoid such an injury; or consult with the plaintiff about her condition and the risks associated with vaginal delivery.

Claiming loss of normal life; pain and suffering; medical expenses; lost wages, earning capacity, and support; and disfigurement, the McGhees seek damages in excess of $50,000, plus attorneys’ fees and costs.

They are represented in the case by D. Jeffrey Ezra of Ezra & Associates, Collinsville.
