Patient drops case alleging doctor caused irreversible damage to toe

A patient claiming she suffered damage to her toe as a result of a misdiagnosis has voluntarily dismissed a medical malpractice lawsuit against an Alton doctor and hospital.

Plaintiff Debbie D. Griffin filed the motion to dismiss without prejudice on Dec. 11 through attorney Bill T. Walker of Granite City, but asked to reserve the right the re-file her complaint within one year.

Circuit Judge Barbara Crowder granted the plaintiff’s motion to dismiss without prejudice on Dec. 16.

Griffin filed her complaint on Sept. 12 against Dr. John E. Lindsay, St. Anthony’s Physician Group and St. Anthony’s Health Center.

According to her complaint, Griffin claims she was a patient of Lindsay’s in September 2012 and was being treated at his office in the St. Anthony’s Health Center. Griffin alleges Lindsay failed to properly diagnose or care for her foot.

Griffin accused the doctor and his employers of negligence and had asked for more than $250,000 in damages for medical expenses, loss of income and court costs.

Edward S. Bott Jr. and Donald K. Schoemaker of Greensfelder, Hemker & Gale, P.C. in St. Louis represented St. Anthony’s Health Center.

No attorney was provided for the remaining defendants.
