Yellow Dog, Weezy’s and Decamp deny liability in Dram Shop suit

Several bars accused in a Dram Shop lawsuit are denying liability involving an alleged assault.

Plaintiff Brett Gillihan filed the lawsuit against Yellow Dog Saloon, Inc., Weezy’a Route 66, Decamp Junction, Inc., and Timothy Hilyard.

According to the complaint, Gillihan alleges Hilyard sold alcoholic beverages at Yellow Dog Saloon in Worden, Weezy’s in Hamel and Decamp Junction in Staunton on April 4, 2014. Hilyard allegedly drank to a point of “impairment and intoxication” and then assaulted Gillihan. The plaintiff says he received serious injuries to his face, head and neck that required medical care.

Gillihan accuses the defendants of negligence and of violating the Dram Shop Act.

Hilyard answered the complaint on Sept. 25 denying the allegations against him.

Yellow Dog Saloon answered the complaint on Oct. 16 denying the allegations and claiming the plaintiff caused his own injuries. The defendant argues Gillihan acted recklessly after becoming intoxicated and then provoked a personal dispute.

Yellow Dog Saloon also claimed that if it did provide Hilyard with alcohol, it was a de minimus amount.

Decamp Junction answered the complaint on Oct. 17 denying the allegations against.

Weezy’s Route 66 also denied the allegations against it in its Oct. 21 answer.

Gillihan seeks more than $50,000 in damages for medical expenses, pain and suffering, disability and lost wages.

Michael Glisson of Alton represents the plaintiff.

Greg Anthony Gaz of Springfield represents Weezy’s Route 66. It requests a jury trial.

Megan J. Bricker of Swanson, Martin & Bell, LLP, in St. Louis represents Decamp Junction.

Patrick G. King of King Law Firm, LLC, in Alton represents Hilyard.

Stephen J. Moore and Matthew R. Buckley of Galloway, Johnson, Tompkins, Burr & Smith, P.C., in St. Louis represent Yellow Dog Saloon. It requests a jury trial.
