A woman has filed suit against the driver who she claims crashed into a utility pole.
Pilar K. Barragan claims she was riding in a 1996 Chevrolet Cavalier defendant Damijon M. Mowrey was driving at the intersection of south and east bound Airport Road near Pierce Lane in Godfrey on Feb. 7, 2013, at about 7:39 p.m. when he lost control of his vehicle and struck a utility pole.
Because of the collision, Barragon suffered head, brain, abdomen, neck, back, spine and muscle injuries and incurred medical costs, the suit states. She also suffered painful, permanent and disabling injuries, endured pain and suffering, lost income and endured disability, disfigurement and the loss of her normal life, according to the complaint filed Feb. 3 in Madison County Circuit Court.
Mowrey negligently failed to keep a proper lookout, failed to stop in time to avoid leaving the road, drove too fast, failed to pay proper attention, failed to react in an appropriate manner, failed to swerve, drove too fast, failed to stop in time to avoid a collision and drove while using a cell phone, among other negligent acts, the suit states.
In addition to Mowrey, Barragan names Jason W. Stewart and Nancy M. Sherwood as defendants, saying they negligently allowed Mowrey to operate their vehicle.
In her complaint, Barragan is seeking a judgment of more than $150,000, plus costs and other relief the court deems just.
