A man has sued Union Pacific Railroad Company, alleging he sustained injuries to his finger when a set of stairs collapsed beneath him.
According to the complaint, James Yazzie was working for defendant Union Pacific Railroad Company on Feb. 2, 2012, when a set of steps collapsed, injuring his finger.
Because of the incident, Yazzie suffered great pain and mental anguish, lost money and experienced a diminished earning capacity, according to the complaint filed Jan. 15 in St. Clair County Circuit Court. He also incurred medical costs, the suit states.
Union Pacific negligently failed to provide safe tools to perform the assigned task, failed to provide Yazzie with proper equipment, failed to provide proper personal protective equipment, failed to provide proper supervision, failed to warn of hazardous conditions and allowed unsafe practices to become standard, the complaint says.
Yazzie seeks a judgment of more than $50,000, plus costs.
