New lung cancer asbestos cases filed in St. Clair County

Four new asbestos claimants have filed suit in the St. Clair County Circuit Court claiming lung cancer as a result of asbestos exposure.

Claimant Harold Joiner filed his case on Oct. 31. He alleges he developed lung cancer in January 2013 as a result of occupational asbestos exposure. The complaint does not indicate the claimant’s residence.

Joiner was employed as a maintenance worker at Saint Vincent Hospital from 1969 to 1971 and as a machine operator at Saint Regis Paper from 1971 to 2001, where he was allegedly exposed to asbestos.

Claimants Paul and Sarah Henderson filed their case on Oct. 28 alleging Paul developed lung cancer in September 2013 as a result of occupational asbestos exposure. The complaint does not indicate the claimants’ residence.

Henderson worked as a maintenance man, laborer, auto repair man, machine operator and a self-employed home builder for various employers from the early 1960s until 2005.

He claims he was occupationally exposed to asbestos through his various employments, causing him to develop his injury.

He also claims secondary asbestos exposure from his father’s work clothing from the 1940s to the 1960s.

Claimants Alfred and Karen Forester filed their case on Oct. 28 alleging he developed lung cancer in September 2012 as a result of occupational asbestos exposure. The complaint does not indicate the claimants’ residence.

Forester claims he was employed as a laborer at Missouri Steel from 1965 to 1969 and as a laborer at General Motors from 1972 to 2004, where he was allegedly exposed to asbestos.

Claimant Samantha Moore, individually and as special administrator of the estate of Ronald Moore, filed her case on Oct. 27 alleging her father developed lung cancer in November 2012 as a result of asbestos exposure, which ultimately contributed to his death one month later. The complaint does not indicate the claimants’ residence.

The decedent served in the U.S. Marines from 1966 to 1969 and was worked as a laborer and a machinist until 2012 after leaving the military. He was allegedly exposed to asbestos at each of his employments spanning the 46 year period.

The claimants allege the defendants had a duty to warn them of the hazards associated with asbestos exposure, among other allegations.

All of the claimants are represented by Randy L. Gori and Barry Julian of Gori, Julian & Associates, P.C. in Edwardsville.
