Yellow Dog, Weezy's and Decamp Junction sued over alleged assault

A man is suing three Madison County bars and one patron whom he says are responsible for an alleged assault.

Brett Gillihan filed a lawsuit against Yellow Dog Saloon Inc., Weezy's Route 66, Decamp Junction Inc. and Timothy Hilyard on Sept. 8 in Madison County Circuit Court.

On April 4, Gillihan alleges Hilyard was sold alcoholic beverages at Yellow Dog Saloon in Worden, Weezy's in Hamel and Decamp Junction in Staunton. According to the complaint, Hilyard drank to a point of "impairment and intoxication" and then assaulted Gillihan. Gillihan says he received serious injuries to his face, head and neck that required medical care.

Gillihan accuses the defendants of negligence and of violating the Dramshop Act. He seeks more than $50,000 in damages for medical expenses, pain and suffering, disability and lost wages.

Attorney Michael Glisson of Alton represents him.

Madison County Circuit Court case number: 14-L-1225.
