Denny's sued by customer over fall on slippery substance

A man has filed suit against Denny’s, alleging he was injured when he fell on a puddle of water on the floor.

Raymond A. Rayburn of Millstadt filed suit July 2 in the St. Clair County Circuit Court against Denny's Inc., doing business as Denny's Restaurant.

According to the complaint, Rayburn was eating at Denny’s in Belleville on April 5 when he slipped on water that had been left on the floor. Because of his fall, Rayburn lost income, incurred medical costs, suffered pain and lost his normal life, according to the complaint.

Rayburn blames Denny’s for causing his fall, saying it placed water on the floor in an attempt to clean it, but failed to warn of its presence, allowed an extremely slippery substance to accumulate on the floor and failed to place signs up in an area where they could be seen by other customers, the suit states.

Rayburn seeks a judgment of more than $50,000, plus costs. He is being represented by attorney Jon E. Rosenstengel of the Law Offices of Bonifield and Rosenstengel in Belleville.
