Slip and fall suit against Granite City Mexican restaurant dismissed

A couple suing a Granite City Mexican restaurant have settled their four-year-old Madison County personal injury suit.

Circuit Judge William Mudge, who had granted summary judgment in favor of defendant El Torero restaurant last November, ordered the case dismissed with prejudice on May 28 with each party to bear their own costs.

Yvonne and Charles Mothershed of Granite City sued in 2010 over an incident they said took place on Jan. 29, 2009, when Yvonne fell on snow and ice that had accumulated on a sidewalk used as the main entrance to the restaurant.

After Mudge granted summary judgment, the Mothersheds moved for reconsideration. However, according to Mudge, the motion was not heard.

The plaintiffs, represented by Christopher Hunter of Hunter and Johnson in Godfrey, and the defendant, represented by Kristine Mack of Donovan Rose Nester in Belleville, filed a stipulation for dismissal on May 28
