Village of Roxana denies woman’s allegations in alleged injury from police raid

The Village of Roxana has denied the allegations brought against it in woman’s lawsuit alleging police officers stepped on her hand during a raid conducted to apprehend a criminal.

According to the March 20 lawsuit filed in Madison County, plaintiff Ashton Luck claims she was in her home when police raided it to apprehend a suspect criminal in March 2013. Luck was not the suspect but claims officers ordered her to stay on the ground and stepped on her extended right hand.

Luck accuses the Village of Roxana and its officers of causing her injuries, failing to conduct the arrest in a safe manner, failing to control bodily movements, failing to keep a proper lookout for bystanders during an arrest and stepping on a bystander’s hand.

In its April 23 answer, the Village of Roxana denied the allegations and demanded a trial by jury.

Luck seeks a judgment of more than $100,000.

Circuit Judge Barbara Crowder presides over the case.

Samuel A. Mormino, Jr. of Mormino, Velloff and Snider in Alton represents the plaintiffs.

Charles A. Pierce of the Pierce Law Firm in Belleville represents the Village of Roxana.
