Man claims injuries following collision

A man claims he suffered back and leg injuries in a rear-end collision.


A. John Depper filed a lawsuit Feb. 18 in the Madison County Circuit Court against Tyler C. Garrett.

In his complaint, Depper claims he was driving a 2000 General Motors Sonoma pickup west on Horseshoe Lake Road on Dec. 22, 2012, when he rear-ended a 2002 Pontiac Grand Prix Garrett was driving in the same direction. The collision occurred after Garrett suddenly and unexpectedly braked, according to the complaint.

Because of the collision, Depper became sick, sore, lame and disordered, suffered great pain and anguish, and endured injuries to his back and legs, the suit states. He also incurred medical costs, suffered internal derangement and has been prevented from participating in his usual activities, the complaint says. In addition, he claims he incurred property damages of $2,674.42.

Depper blames Garrett for causing the collision, saying he negligently failed to keep his vehicle under proper control, failed to see Depper’s vehicle behind him, failed to drive at a safe speed, drove recklessly, suddenly braked and improperly used a traffic lane.

Depper is seeking a judgment of more than $52,674.72, plus costs and other relief the court deems just. He is being represented by Richard G. Reed of Reed and Bruhn in Belleville.
