Mother sues over Venice accident, claims driver was distracted

The mother of a minor has filed suit against the driver who she claims rear-ended the vehicle in which her son was riding.

Nicholas Nunn, a minor by his mother and next friend Carrie McGee, filed a lawsuit Feb. 3 in the Madison County Circuit Court against Jean Lecointre.

McGee claims her son was riding in a vehicle in Venice on July 23, 2012, when the defendant rear-ended the vehicle. Because of the collision, Nunn suffered disability and disfigurement, experienced great pain and mental anguish, lost earnings, incurred medical costs and sustained a seriously diminished earning capacity, according to the complaint.

Lecointre negligently failed to reduce her speed to avoid a collision, drove while distracted, failed to properly apply her brakes, drove in such a manner so as to collide with the rear of Nunn’s vehicle and failed to keep a proper lookout, the suit states.

McGee is seeking a judgment of more than $50,000, plus costs and other relief the court deems just. She is being represented by Gregory M. Tobin of Pratt and Tobin in East Alton.
