A woman claims her son’s finger was partially severed after it was stuck in a door at a Troy McDonald's.
Connie Wilkinson filed a lawsuit Jan. 29 in the Madison County Circuit Court against McDonald's.
In her complaint, Connie Wilkinson alleges her son, Tyler Wilkinson, was celebrating his fourth birthday at McDonald's when he attempted to use the men’s restroom on Sept. 20, 2010.
While the plaintiff was entering and passing through the entrance to the men’s restroom, the door shut while the plaintiff’s finger was inside the door jam, and as a result, the plaintiff sustained a serious and permanent physical injury, according to the suit. Because of the incident, Tyler’s finger was partially severed and he suffered pain, the complaint says.
Connie Wilkinson blames McDonald's for causing her son’s injuries, saying the restaurant’s owners negligently allowed the door to become dangerous, failed to install proper door guards, failed to inspect the restroom door and failed to warn people about the door.
Connie Wilkinson is seeking a judgment of more than $10,000, but less than $50,000, plus costs and other relief the court deems just.
