Jerseyville Manor sued for alleged violations of the Nursing Home Care Act

A nursing home is facing suit over claims it violated the Nursing Home Care Act, resulting in death.


Kristen Warnhoff, special administrator of the estate of Sandy Kay Kitzmiller, deceased, filed a lawsuit Jan. 23 in Madison County Circuit Court against Illini Manors Inc., doing business as Jerseyville Manor, UDI No. 11, doing business as Jerseyville Manor, RFMS Inc., Cristy Elving MD and Illini Medical Associates SC, citing violations of the Nursing Home Care Act, wrongful death and professional negligence.

Warnhoff states Kitzmiller was a resident at the Jerseyville Manor at 1251 N. State St., Jerseyville, from late fall 2011 until Jan. 19, 2012. According to the complaint, the defendants' committed numerous violations of the Nursing Home Care Act, including failing to provide appropriate treatment and services to prevent urinary tract infections, failing to provide necessary personal hygiene and failing to prevent development of pressure sores. The plaintiff contends that as a direct result of the defendants' wrongful acts, Kitzmiller died on March 30, 2012.

Warnhoff is seeking damages in excess of $50,000 and is being represented in the case by Paul W. Johnson of SL Chapman LLC.
