Suit: Drunk partygoer being driven home in his own car, yanks gearshift, causes crash

Plaintiff Daniel L. Hoerchler is suing over injuries he says were caused by the reckless acts of an intoxicated passenger.


Hoerchler alleges in a suit filed in Madison County Circuit Court on Jan. 9 that he had attended a party with Robert Harlow on Jan. 10, 2012.

He claims that Harlow became too intoxicated to drive, so he ended up giving Harlow a ride home in Harlow's car. According to his complaint, Hoerchler was driving when Harlow, in his allegedly inebriated state, grabbed the car's gearshift to change gears while the car was in motion.

Hoerchler claims they were driving on Lower Marine Road in Marine Township when Harlow's actions caused the car to go off the road and crash.

Hoerchler claims to have been injured in the crash and is now suing Harlow for his role in the accident.

Hoerchler is seeking more than $50,000 in damages. He is being represented by attorney D. Jeffrey Ezra.
