Construction supervisor sues after being run over by truck carrying rocks

A man was supervising a construction site when he was run over by a truck carrying rocks, according to recently filed court documents.

Ed and Debra Finazzo filed a lawsuit Nov. 22 in St. Clair County Circuit Court against Canteen Township, Mound Public Water District, Haier Plumbing and Heating, Obermeier Truck Service and Derek Bleisch.

Ed Finazzo claims he was working for Juneau Associates and supervising work performed by defendant Haier Plumbing and Heating on Dec. 14, 2012, when Bleisch, who was driving a truck for Obermeier, backed over Ed Finazzo. At the time, Bleisch was delivering rock to Haier, according to the complaint.

Because of the incident, Ed Finazzo suffered severe and disabling injuries to his legs and back; incurred medical costs, suffered great physical pain and suffering; and suffered disability, the suit states. He also lost earnings and suffered an impaired earning capacity, the complaint says.

Debra Finazzo, who was married to Ed Finazzo at the time of the incident, claims she lost her husband’s society, companionship and services due to the incident.

Ed Finazzo was working in Canteen Township and Mound Public Water District at the time of his injuries. He names them as defendants, saying they negligently failed to require that swampers be assigned to the work site, failed to require that storage areas be located in areas that would not require large trucks to back up and failed to require that motorized traffic and delivery areas were established.

He also names Obermeier and Bleisch as defendants, saying Bleisch negligently backed Obermeier’s vehicle over a long distance to reach a delivery location, failed to advise of the delivery of materials before backing into the work area, failed to observe Ed Finazzo before backing over him and failed to avoid running over Ed Finazzo.

In their complaint, the Finazzos seek a judgment of more than $500,000, plus damages and costs.
