Man alleging he fell on electrical stud adds defendants to personal injury suit

A man claiming he tripped over an unmarked electrical stud while he was working amended his complaint after learning of a possible additional defendant.

Plaintiff Daniel Garnett filed a petition for leave to file an amended complaint on Nov. 26 saying he “learned the identity and whereabouts of an additional possibly negligent entity in connection with the events which occurred involving the construction site.”

Circuit Judge Andrew Gleeson granted the petition for leave on Nov. 26.

According to the original complaint filed Nov. 8, Garnett claims he was installing and moving rebar at a river grain terminal in Fairmont City on Dec. 1, 2011, when he fell over an unmarked electrical stud.

He accuses Guarantee Electrical Company, Bunge-SCF Grain, Alberici Constructors, Ambassador Steel Fabrication and Vee-Jay Cement Contracting Company in the lawsuit.

Garnett filed his amended complaint through attorney Kenneth B. Beljanski of Brown and Brown in Fairview Heights. He added Guarantee Electrical Construction Company and Paynecrest Electric Inc as defendants.

The defendants are blamed for failing to keep the work area safe, failing to maintain safe electrical studs, failing to inspect the work area and make sure it was safe, allowing electrical studs to create a dangerous condition and failing to properly maintain electrical studs, the suit states.

He seeks a judgment of more than $300,000.

Attorneys for the defendants have not yet been identified.
