Industrial Rail sues Doe Run over repair costs

An Edwardsville company has filed suit against the corporation that it claims failed to pay repair costs for a vehicle it leased.

Industrial Rail Parts and Services filed a lawsuit Dec. 9 in Madison County Circuit Court against The Doe Run Resources Corporation doing business as the Doe Run Company.

In its complaint, Industrial Rail Parts claims it leased a switch locomotive to Doe Run Company for $300 each day. On Aug. 1, 2012, the payments increased to $325 per day, according to the complaint.

The lease lasted until March 2 after a Doe Run supervisor provided a 30-day notice terminating the lease agreement, the suit states.

Industrial Rail Parts and Services inspected its vehicle on March 3 when it found defective air lines and valves that needed repairs. In turn, it billed the Doe Run Company $2,647.65, the complaint says.

However, Doe Run Company has refused to pay the invoice, Industrial Rail Parts and Services claims.

On May 28, Industrial Rail Parts and Services sent Doe Run Company another invoice for $13,348.95 for the modifications, charges and fees it spent to transport the switch locomotive to Illinois, according to the complaint. Doe Run Company has also failed to pay that requested amount, the suit states.

When the locomotive reached the Illinois rail yard, Industrial Rail Parts and Services employees performed a final inspection to determine any additional necessary repairs. They determined that Doe Run Company owed them $113,327, the complaint says. Again, however, Doe Run Company refuses to pay the money, Industrial Rail Parts claims.

In addition to the money it claims Doe Run Company owes it, Industrial Rail Parts and Services seeks attorneys’ fees, costs, post-judgment interest and other relief the court deems just.
