Madison County Circuit Judge Dennis Ruth has scheduled a jury trial in a lawsuit alleging a monkey bit a minor boy at a Godfrey park.
The jury trial is set for Oct. 6, 2014, at 9 a.m. A pre-trial hearing is set for Aug. 20, 2014, at 10:30 a.m.
In an order filed Nov. 20, Ruth gave the parties until Sept. 1, 2014, to complete discovery and depositions.
According to the complaint filed by Jacob Calvert, the plaintiff’s son Ayden Calvert, was allegedly attacked and bitten by a Java Macaque Monkey named Nina at Godfrey Glazebrook Park in Godfrey on June 2.
The suit was filed under the dog bit statute, which holds that an animal’s owner is responsible for a victim’s medical expenses.
The monkey’s owner, Kendra Hougland, is named the defendant in the case.
The plaintiff seeks an unknown judgment of more than $50,000.
